- Who We Are
HARTMANN Academy (the ‘’ACADEMY’’) is the e-learning platform of PAUL HARTMANN AG (‘’HARTMANN’’) aimed to provide healthcare professionals (like nurses, nurse practitioners, physicians etc.), pharmacist, sales representatives of drugs and medical devices (like pharmacists, pharmaceutical sales representatives etc.) as well as resellers with trainings, events, webinars, and scientific content on diagnostics, wound care, incontinence, disinfection and risk prevention.

HARTMANN operates the ACADEMY website www.hartmann-academy.info and manages the user’s registration, de-registration, user’s settings as well as the subscription and un- subscription of additional services in connection with the ACADEMY website.

2. Access
The ACADEMY website and certain areas of the website can be used without registration. Access, enrolment, and participation in the ACADEMY training courses requires registration.
With registration the user is accepting these Terms and Conditions and acknowledges that the sharing of his username and password with another person to access the ACADEMY training content is not permitted.
HARTMANN will implement reasonable technical measures to provide uninterrupted access to the website and training courses. Access may be temporarily restricted for technical reasons, e.g. due to necessary maintenance and repair work. HARTMANN expressively reserves the right to block the access to the ACADEMY website or parts of it at its own discretion at any time without the obligation to provide a reason.
HARTMANN also reserves the right to block any user account and/or to terminate a user account without giving reason at any time without notice, especially if the user has provided a false identity, is providing untrue or incorrect information or violates these Terms and Conditions.
HARTMANN is entitled to discontinue the operation of the ACADEMY website in whole or in part at any time. In this respect, HARTMANN assumes no responsibility and is not liable for the uninterrupted availability of the ACADEMY website.
3.ACADEMY Content
HARTMANN aim is to provide courses and materials of the highest quality. All offers on the ACADEMY website are subject to change and are non-binding. HARTMANN expressly reserves the right to change, supplement or delete parts or the entire offer at any time without prior notice.
The use of information, training, software, and documentation made available on the ACADEMY website as well as any updates thereof ("ACADEMY contents") shall be subject to these Terms and Conditions, whereby separately agreed license conditions shall always take precedence over these Terms and Conditions.
The contents of the ACADEMY may contain general descriptions of the technical possibilities of individual HARTMANN products, which may not always be available in individual cases (e.g. due to product changes). These general descriptions do not claim to be complete or correct. Such general descriptions are also not to be understood as contractual guarantees and the user accepts that the required performance of the products corresponds to the performance agreed at the time the ACADEMY was accessed.
In any case, the content offered is subject to the Disclaimer of Warranties / Limitation of Liabilities section below.
4.License and Use of Materials
HARTMANN grants the user a non-exclusive, non-transferable, and non-assignable right to use the contents of the ACADEMY website and training materials to the extent agreed between HARTMANN and the user or, in the absence of such an agreement, to the extent that corresponds to the purpose obviously pursued by HARTMANN in making the ACADEMY contents and training materials available.
The user is not allowed to copy, modify, transmit, distribute, reproduce, sell, resell, or in any way exploit any portion of the ACADEMY content or other copyrighted materials provided on the ACADEMY website other than for the user’s individual training. Any other purpose is expressly prohibited under these Terms and Conditions. The user shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit ACADEMY content or any other copyrighted materials.
The user is not allowed to pass on the ACADEMY content and training materials to third parties or make them accessible in any other way. Unless mandatory legal provisions to the contrary apply, the user may not modify, disassemble, decrypt, or decompile ACADEMY content.
5.User Content
All content posted by a user on the ACADEMY website (e.g. contributions, comments, etc.) is the sole responsibility of the individual user. HARTMANN cannot be held liable in the event of a violation of applicable law. However, HARTMANN reserves the right to delete such content that violates applicable law (in particular in the case of violation of personal rights of other users) at any time without prior notice.
The user shall not:
- infringe the personal rights of third parties.
- infringe intellectual property or other proprietary rights.
- upload, store, or distribute content containing malwares such as viruses, Trojans, worms, spyware, or other malicious programs.
- upload, store, or distribute hyperlinks or content that is illegal, violates confidentiality obligations or to which the user is not entitled.
- distribute advertising material or unsolicited e-mail ("spam"), including false warnings of viruses, defects, etc.
HARTMANN will block immediately the user's access to the ACADEMY website, without prejudice to other legal remedies, if the user violates the above-mentioned provisions.
6.Disclaimer of Warranty / Limitation of Liabilities
To the extent permitted by law, HARTMANN does not warrant, and hereby disclaim any warranties, representations and/or other terms which may apply to the ACADEMY website, any content on it or a link to a site, whether express or implied including no representations or warranties as to the accuracy or completeness of any content, availability, merchantability or fitness for a particular purpose and no representations or warranties that the service or anything else provided pursuant to this agreement will not infringe proprietary rights of third parties.
The service is provided "as is," and HARTMANN does not warrant that (a) content will meet the user’s requirements or expectations or achieve the intended purposes, (b) content will not experience outages or otherwise be uninterrupted, timely, secure or error-free, (c) the information or services obtained through or from the content will be accurate, complete, current, error-free, completely secure or reliable, or (d) that defects in or on the content will be corrected.
The ACADEMY website may contain information or data provided by third parties. HARTMANN assumes no responsibility for any content referred to or websites linked on the ACADEMY website. HARTMANN has no influence on the current and future design, content, or authorship of the external websites. Such links should not be interpreted as endorsement by HARTMANN of those linked websites. HARTMANN therefore expressly distances itself from the current and future design, content, or authorship of external websites and will not be liable for any loss or damage that may arise from the users’ use of them.
In no event shall HARTMANN, its affiliates, directors, officers, employees, agents and licensors be liable to the user or to any third party for any loss or damage (including any direct, indirect, incidental, and/or consequential losses), whether in contract, tort (including negligence), breach of statutory duty, or otherwise arising under or in connection with the (a) use of, or inability to use, the content (or any part of it) on the ACADEMY website, and/or (b) use of or reliance on any content displayed on the ACADEMY website whether or not HARTMANN have been advised of the possibility of such claims and/or losses in advance, and even if such claim or loss is foreseeable or (c) punitive damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability (whether in contract, tort or otherwise), arising out of or in connection with the use or performance of the training or the content therein.
The user acknowledges and agree that the warranty disclaimers and the limitations of liability set forth in these Terms and Conditions reflect a reasonable and fair allocation of risk between the user and HARTMANN, especially with regards to the fact that the use of the iso platform is currently free of charge.
HARTMANN will not be liable to the user for any breach of any of the Terms and Conditions associated with the use of the ACADEMY website.
7.Copyright and Trademarks
The ACADEMY content and training materials are protected by copyright laws, international copyright treaties and other intellectual property laws and agreements, and the user shall comply with such laws and agreements. In particular, the user shall not remove any alphanumeric codes, trademarks or copyright notices from the ACADEMY content and training materials.
All rights, title and interest in intellectual property rights relating to the ACADEMY content including copyright, patents, trademarks, developments, proprietary information, know-how, processes, methods and other proprietary rights (including computer software and design materials thereof) and all other intellectual property (whether registered or not) are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners.
The copyright for published objects created by HARTMANN itself remains solely with HARTMANN. Reproduction or use of copyrighted content is not permitted without the prior written consent of HARTMANN or the respective registered owner. All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorized use is prohibited.
8.Indemnification
The user agree to indemnify, defend and hold harmless HARTMANN and each of their respective officers, directors, agents, employees, and assignees from any and all claims, liabilities, expenses and damages, including reasonable attorneys’ fees and costs, made by any third party relating to or arising out of (a) the users use or attempted use of the ACADEMY website or content in violation of the Terms and Conditions or any applicable laws (b) the user’s violation of any law or rights of any third party or (c) information that the user posted or otherwise made available on the ACADEMY website or through the content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
9.Termination Rights
HARTMANN reserves the right, at its sole discretion, to terminate for any user the use of the ACADEMY website or his participation in it, for any reason or no reason and that HARTMANN shall not have any liability to the user for such action. The user further agrees that HARTMANN has the right to cancel, delay, reschedule or alter the format of any content at any time, and that HARTMANN shall not have any liability to the user for any such action. If the user no longer desires to participate in the activities of the ACADEMY website, the user may terminate his participation therein upon notice to HARTMANN.
10.Change to the Terms and Conditions
HARTMANN reserves the right to revise these Terms and Conditions at any time and without notice, other than through posting the updated terms and respective date of update on its webpage. Any changes made shall have immediate effect upon being posted to its webpage and the continuation of use of the ACADEMY website, after the changes have been made, constitutes the user’s acceptance of such amended Terms and Conditions.
HARTMANN reserves the right to change the currently free of charge access to the ACADEMY website content to paid services at any time.
11.Severability and Waiver
Should any provision of these Terms and Conditions be or become invalid in whole or in part, be unlawful, or unenforceable by a competent body, or should there be a gap in these Terms and Conditions, this shall not affect the validity, legality, or enforceability of the remaining provisions within these Terms and Conditions. In place of the invalid provision and to fill any gaps, the statutory provision shall apply.
The part or clause that would be held invalid, unlawful, or unenforceable shall be replaced by another part or clause, the content of which shall be as close as legally possible to the original part or clause.
If HARTMANN does not enforce any right conferred to it under these Terms and Conditions, such non-enforcement shall not constitute a waiver of that right.
12.Jurisdiction
These terms and conditions shall be governed exclusively by German law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11.4.1980 (UN Sales Convention).
The place of jurisdiction for all disputes arising in connection with the use of the ACADEMY website shall be the Stuttgart Regional Court, provided that the parties to the respective contractual relationship are merchants within the meaning of the German Commercial Code (HGB).
